Welcome to AskingToBot. These Terms and Conditions ("Terms") govern your use of our AI-powered chatbot service. By creating an account or using our service, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using AskingToBot, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the service.
- You must be at least 18 years old to use this service
- If you are under 18, you must have parental or guardian consent
- You represent that you have the authority to bind yourself or your organization to these Terms
- We reserve the right to update these Terms at any time with notice via email
2. Service Description
AskingToBot is a Software-as-a-Service (SaaS) platform that provides:
- AI-powered chatbots: Create and deploy chatbots for your website
- Training capabilities: Upload documents and Q&A pairs to train your chatbot
- RAG technology: Advanced retrieval augmented generation for accurate responses
- Lead generation: Collect and manage conversations with your website visitors
- Analytics: Track chatbot performance and visitor engagement
- Multiple tiers: Free and paid subscription plans with varying features
Features and limitations vary by subscription tier. We reserve the right to modify, suspend, or discontinue any feature at any time.
3. Account Registration and Security
3.1 Account Creation
To use our service, you must:
- Provide accurate and complete information during registration
- Maintain one account per user (no duplicate accounts)
- Verify your email address
- Accept these Terms and our Privacy Policy
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using a strong, unique password
3.3 Prohibited Activities
You agree NOT to:
- ❌ Use the service for illegal activities or distribute illegal content
- ❌ Send spam or unsolicited marketing through your chatbots
- ❌ Attempt to access other users' accounts or data
- ❌ Upload malicious code, viruses, or harmful software
- ❌ Reverse engineer, decompile, or hack the platform
- ❌ Resell or white-label the service without written permission
- ❌ Violate any applicable laws or regulations
- ❌ Impersonate any person or entity
- ❌ Collect user data without proper consent
4. Subscription and Billing
4.1 Subscription Tiers
We offer multiple subscription tiers:
- Free tier: 1 chatbot, limited features, 5 documents, basic support
- Paid tiers: Variable pricing based on chatbot limits, features, and usage
4.2 Billing and Payments
- Subscriptions are billed monthly or yearly in advance
- Payments are processed via Razorpay or Stripe
- Prices are in USD or INR as displayed at time of purchase
- You authorize automatic renewal unless you cancel before the renewal date
- We reserve the right to change pricing with 30 days notice to existing customers
4.3 Refund Policy
No refunds: Subscription fees are non-refundable except:

You may cancel your subscription at any time from your account settings. Upon cancellation:
- Your access continues until the end of the current billing period
- No refund for the remaining period (unless we terminate service)
- You have 30 days to export your leads data
- All other data will be deleted after 30 days
⚠️ 5. Service Termination Rights
IMPORTANT: Please read this section carefully as it outlines our rights to terminate service.
5.1 User-Initiated Termination
You may terminate your account at any time by:
- Cancelling your subscription from account settings
- Requesting account deletion via email to mandeep@askingtobot.com
After cancellation, your access continues until the end of your current billing period, and you have 30 days to export your leads data.
5.2 Service Provider Termination Rights
We reserve the right to suspend or terminate the service or your account under the following circumstances:
A. 15-Day Notice Termination
We may terminate the service or your account with 15 days written notice via email for any reason, including but not limited to:
- Business restructuring or operational changes
- Service discontinuation or pivot to different offerings
- Technical limitations or infrastructure constraints
- Strategic business decisions
In this case, you will receive:
- ✅ 15 days advance notice via email
- ✅ 30-day window to export your leads data
- ✅ Clear timeline for data deletion
B. Profitability Clause
We operate this service as a commercial business. If the platform becomes unprofitable or financially unsustainable to operate, we reserve the right to:
- Terminate the service with 15 days written notice via email
- Provide a full prorated refund for any unused subscription time
- Grant you a 30-day window to export your leads data
- Notify you of the exact data deletion timeline
This clause protects our right to discontinue the service if it is not economically viable to continue operations.
C. Immediate Termination (No Notice)
We may immediately suspend or terminate your account without notice if:
- You violate these Terms of Service or our Privacy Policy
- You engage in fraudulent activity or payment disputes/chargebacks
- You abuse the service or engage in malicious behavior
- You upload illegal content or violate applicable laws
- Your account poses a security risk to our systems or other users
- Required by law, court order, or government authority
- You harass our staff or other users
⚠️ In case of immediate termination for violations, NO REFUND will be provided.
5.3 Effect of Termination
Upon termination of your account or the service (by either party):
- Your subscription will be cancelled (no recurring charges)
- Your access to the platform will be immediately revoked
- You will have 30 days to export your leads data (see Section 6 for details)
- All other data (chatbots, training data, documents, embeddings) will be permanently deleted within 30 days
- Your email will be removed from our marketing lists
- Any outstanding payments remain due and payable
📦 6. Data Rights and Export
6.1 Data You Can Export
Upon account termination or cancellation, you have the right to export the following data:
✅ Exportable Data: LEADS ONLY
- Chat conversations: All messages exchanged between your chatbot and visitors
- Visitor information: Names, emails, and contact details collected through chats
- Chat sessions: Session metadata, timestamps, and conversation history
- Lead analytics: Basic statistics about your leads
Format: CSV or JSON (machine-readable, portable to other systems)
Access: Self-service download from your account dashboard, or request via email to mandeep@askingtobot.com
6.2 Data That Will Be Permanently Deleted
The following data is considered service configuration and will be permanently deleted within 30 days of account termination:
❌ Non-Exportable Data (Will Be Deleted)
- Chatbot configurations: Settings, customizations, widget code, branding
- Training pairs: Question and answer pairs you created
- Uploaded documents: PDF files, markdown files, text files, and URLs
- Document embeddings: AI-generated vector embeddings (1536 dimensions)
- Document chunks: Text chunks created for vector search
- Internal analytics: Usage logs, performance metrics, system data
- Account settings: Preferences, notification settings
⚠️ This data cannot be recovered after deletion. Please export your leads data before the 30-day deadline.
6.3 Data Export Process and Timeline
- During active subscription: Export leads data anytime from your dashboard
- After cancellation: 30-day grace period to export leads data
- Email notification: We will send reminders at 7 days and 1 day before data deletion
- After 30 days: All data (including leads) is permanently deleted and cannot be recovered
- Assistance: Contact mandeep@askingtobot.com if you need help exporting data
6.4 Data Retention for Legal Compliance
Certain data may be retained longer for legal, tax, or regulatory compliance:
- Billing records: Retained for 7 years for tax purposes
- Fraud prevention logs: Retained for 90 days
- Legal hold: Data subject to legal proceedings may be retained as required by law
7. Intellectual Property
7.1 Your Content
You retain ownership of:
- Training data (Q&A pairs you create)
- Uploaded documents and content
- Chatbot customizations and branding
- Leads data collected through your chatbots
7.2 License to Us
By uploading content to our platform, you grant us a limited, non-exclusive, worldwide license to:
- Store and process your content to provide the service
- Generate AI embeddings from your documents (via OpenAI API)
- Display your chatbots on your designated websites
- Backup and secure your data
Important: We will NOT use your proprietary training data to improve our general AI models or share it with competitors without your explicit consent.
7.3 Our Platform
We retain all rights to:
- The AskingToBot platform, software, and codebase
- AskingToBot branding, logos, and trademarks
- Platform features, algorithms, and technology
- Documentation, tutorials, and support materials
8. Acceptable Use Policy
You agree to use AskingToBot in compliance with all applicable laws and regulations. Prohibited uses include:
- Distributing illegal, harmful, or offensive content
- Violating intellectual property rights of others
- Sending unsolicited spam or marketing messages
- Collecting personal data without proper consent (GDPR/CCPA compliance required)
- Impersonating any person, business, or entity
- Interfering with or disrupting the service
- Attempting to gain unauthorized access to our systems
- Using the service for fraudulent activities
- Exceeding reasonable rate limits or abusing API access
9. Limitation of Liability
PLEASE READ THIS SECTION CAREFULLY AS IT LIMITS OUR LIABILITY TO YOU.
9.1 "As Is" Service
The service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- No guarantee of uninterrupted or error-free service
- No guarantee of specific uptime (target: 99.9%, but not guaranteed)
- No warranty of merchantability or fitness for a particular purpose
- No guarantee that the service will meet your specific requirements
9.2 Maximum Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to these Terms or the service shall not exceed the total amount you paid us in the 12 months preceding the claim.
9.3 No Liability For
We are NOT liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or downtime
- Third-party services (OpenAI, Razorpay, Stripe, DigitalOcean)
- Incorrect or inaccurate chatbot responses
- Data loss due to user error or failure to export data
- Actions or inactions of your website visitors
10. Indemnification
You agree to indemnify, defend, and hold harmless AskingToBot, its owners, employees, and partners from any claims, liabilities, damages, or expenses (including legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any laws or regulations
- Content you upload or display through your chatbots
- Third-party claims related to your chatbots or business
- Infringement of intellectual property rights
11. Dispute Resolution
11.1 Informal Resolution
If you have a dispute, please contact us first at mandeep@askingtobot.com to try to resolve it informally. Most issues can be resolved through good-faith discussion.
11.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
11.3 Arbitration
For disputes that cannot be resolved informally, both parties agree to binding arbitration for claims exceeding $10,000 USD.
12. Service Level and Support
12.1 Uptime Target
We target 99.9% uptime, excluding scheduled maintenance. However, this is a target and not a guarantee. We are not liable for service interruptions.
12.2 Support

- Response time: Best effort basis, varies by subscription tier
- No SLA: We do not guarantee specific support response times
13. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes:
- We will notify you via email at least 30 days before changes take effect
- We will update the "Last updated" date at the top of this page
- Material changes may require re-acceptance of the Terms
- Your continued use of the service after changes constitutes acceptance
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AskingToBot and supersede all prior agreements.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
